PENGENDALIAN PERDAGANGAN SAMPAH ELEKTRONIK: KAJIAN PERJANJIAN INTERNASIONAL DAN KEBIJAKAN PERDAGANGAN

Abstract
Problematik pengendalian perdagangan sampah elektronik dari aspek perjanjian internasional terletak pada Konvensi Basel dan Persetujuan Perdagangan Barang dalam GATT/WTO. Konvensi Basel tidak memberikan definisi sampah elektronik namun telah melarang adanya perpindahan limbah Bahan Berbahaya dan Beracun (B3) yang di dalamnya termasuk sampah elektronik sedangkan dalam ketentuan GATT/WTO sampah elektronik dikategorikan sebagai barang (goods) bekas. Dua hal yang saling bertentangan. Kebijakan Indonesia telah melarang import limbah B3 (termasuk sampah elektronik), meskipun tidak melarang ekspor. Perlu pemberdayaan kualitas kelembagaan, penegakan hukum, dan sikap masyarakat terhadap sampah elektronik.
