Abstract

The protection of policy holder still is weakness, if we are know in the insurance cases. Policy holder will be always loss, because of do not understand about the content of  contract agreement between policy holder and insurance company ( insurer). Valid or not valid about that contract be appear from Standardized Contract for binding or effective for that party still debatablle in lawyer. This situation is responsive for law community to look for justice for police holder will be occur in weakness position be up against insurance company will be position as strong party. The agent of the company in cover this transaction by preparing a modelled draft of contract for signing by the partner of contract aware or not aware already constraint the freedom of contract.

Abstract

Perlindungan terhadap pemegang polis masih sangat lemah, jika kita melihat dari kasus-kasus asuransi. Tertanggung atau pemegang polis akan selalu dirugikan disebabkan oleh ketidakpahamannya tentang isi kontrak perjanjian antara pemegang polis dengan perusahaan asuransi. Sah tidaknya suatu perikatan yang timbul dari suatu kontrak standar untuk mengikat, ataupun berlaku sebagai hukum bagi para pihak yang berkontrak masih sering diperdebatkan di kalangan para ahli hukum. Hal ini merupakan respon masyarakat hukum untuk mencari keadilan bagi tertanggung/pemegang polis yang sering ditempatkan pada posisi yang lemah menghadapi perusahaan asuransi yang diposisikan  sebagai pihak yang menang. Pelaku usaha dalam menutup suatu transaksi dengan terlebih dahulu telah menyiapkan format-format yang umumnya telah tercetak untuk ditandatangani oleh mitra kontraknya disadari atau tidak telah menghilangkan/membatasi kebebasan berkontrak.
