IMPLEMENTASI MODEL PARATE EXECUTIE ATAS JAMINAN FIDUSIA: (Uji Model Eksekusi Jaminan Fidusia)

Abstract

This research is purposed to measure the Fiduciary Parate Execution Model (FPEM) in solving concrete events based on analogy. The problems include: 1) the implementation of FPEM; 2) the obstacles in testing of FPEM; and 3) the forming of regulation as a construction to overcome the obstacles of FPEM. The method of this research is normative legal approach armed with system of self explanatory which a norm is a rule or an authoritative standard or what law ought to be. The result of FPEM is a recommendation in which contains the prescriptive value i.e the forming of regulation on FPEM.

Penelitian ini bertujuan untuk mengukur pelaksanaan Model Parate Eksekusi Jaminan Fidusia (MPEJF) dalam memecahkan peristiwa konkret berdasarkan analogi. Permasalahannya meliputi: 1) Implementasi MPEJF; 2) Kendala pengujian MPEJF; dan 3) Pembentukan peraturan sebagai konstruksi ideal untuk mengatasi kendala MPEJF. Metode penelitian yang digunakan adalah metode pendekatan normatif yang didukung oleh sistem“self-explanatory” dimana suatu norma adalah suatu aturan atau ukuran bersifat mengikat atau hukum yang seharusnya. Hasil dari MPEJF bersifat rekomendasi atau preskriptif yaitu bentuk rancangan regulasi tentang parate EJF.
