PENERAPAN METODE REGULATORY IMPACT ASSESSMENT (RIA) DALAM PENYUSUNAN REGULASI DAERAH

Abstract

The making of regional regulations so far has been in the form of legal drafting focusing on adjustability and obedience to the higher laws. However, it has not considered the aspirations and roles of stakeholders and public participation, RIA (Regulatory Impact Assessment) can be used as a systematical means of evaluation to regional regulations so that they will be more contextual, aspired, responsive, quality, effective , and efficient.

Penyusunan regulasi  daerah setingkat peraturan daerah  selama ini lebih bersifat legal drafting, menekankan kepada kesesuaian dan kepatuhan terhadap peraturan perundang-undangan yang lebih tinggi, namun belum  memandang penting aspirasi dan peran pemangku kebijakan serta partisipasi publik. RIA (Regulatory Impact Assessment) dapat dipergunakan  sebagai  piranti evaluasi secara sistematis terhadap  regulasi daerah  sehingga menjadi lebih kontekstual, aspiratif, responsif, berkualitas, efektif dan efisien
