Marital property settings in the UUP is also a commitment to legal unification efforts to resolve conflicts that may arise between the parties due to legal pluralism. Until now there are factually plurality of marriage property law in Indonesia, as stated in Customary Law, Islamic Law (Islamic Law Compilation) and KUH.Perdata other than those listed in the UUP as positive law. Based on various court decisions in Indonesia, it turns out the reality of plurality of marriage property law lead to the unification of law by applying the UUP for the entire group. In addition to the concept of justice in various disputes the judge's decision marital property is dominated by procedural fairness. Procedural fairness that the judge used this greatly affects the balanced nature of the position of partner in marriage and by the Supreme Court's decision dated December 9, 1959 No. 424 K/Sip/1959 and Supreme Court ruling dated 9 November 1976. No. 1448 K/Sip/1974 and judges tend to follow this jurisprudence. The concept of justice that judges tend to be used by John Rawls theory of justice that emphasizes formal justice. When drawn back again, in practice in the courts based on the paradigm of positivism who gave birth and put the judges legisme flow as a funnel law. With the paradigm of justice that would be obtained is the formal justice or procedural fairness. Keywords : Justice. Marital property, legal pluralism . Abstrak Penerbitan UU No. 1 tahun 1974 Tentang Perkawinan (UUP) merupakan fenomena menarik mengenai usaha untuk memperoleh keadaan normatif yang tunggal untuk seluruh wilayah di tengah realitas kemajemukan. Meskipun UUP bersifat “unifikasi”, namun faktanya merupakan “unifikasi dalam keragaman”.Penerapan UUP hingga kini masih memunculkan berbagai persoalan. Hal ini menunjukkan adanya dimensi yang berbeda dalam pemaknaan terhadap bidang perkawinan, termasuk bidang harta kekayaan perkawinan, yang muaranya dalam implementasinya banyak ketentuan di dalamnya yang menimbulkan pro kontra.Hasil penelitian menunjukkan dalam praktik di pengadilan negeri masih digunakan tiga dasar hukum untuk menyelesaikan sengketa harta kekayaan perkawinan, yakni : hukum adat, KUH.Perdata dan UUP. Selain pluralitas aturan, juga terdapat pluralitas bentuk harta kekayaan perkawinan akibat adanya perjanjian kawin. Selain itu, dari hasil studi juga menunjukkan bahwa putusan-putusan sengketa harta kekayaan perkawinan di pengadilan negeri berorientasi pada keadilan prosedural. Hal demikian akibat dominannya pengaruh paradigma positivistik dan penekanan kebenaran formil dalam perkara perdata, yang menyebabkan termarjinalkannya keadilan substantif. Dasar untuk membagi sama besar atas obyek sengketa yang terbukti sebagai harta bersama adalah putusan Mahkamah Agung tanggal 9 Desember 1959 No. 424 K/Sip/1959 dan putusan Mahkamah Agung tanggal 9 November 1976 No. 1448 K/Sip/1974. Konsep keadilan pembagian demikian merupakan konsep keadilan formal yang dilandasi teori keadilan Joh Rawl. Dalam konteks penyelesaian sengketa harta kekayaan perkawinan, keadilan yang dicari adalah keadilan substantif. Paradigma hukum progresif yang lebih mementingkan keadilan yang sifatnya substansial daripada keadilan yang sifatnya prosedural, adalah tepat untuk mewujudkan hukum yang adil.
