Penafsiran dan pemaknaannya lebih dimonopoli penguasa. Maknanya menjadi demikian simbolik. Ia lebih diberi ”bobot” sebagai simbol-simbol idiologis-normatif yang—sejatinya—menjauhkan dari makna substansialnya. Pancasila terpasung dalam dunia yang tidak jujur dan tidak otentik. Karenanya, begitu ketika Orde Baru runtuh, masyarakat enggan, bahkan menghindar untuk berbicara Pancasila di ruang publik. Keengganan dan kegamangan publik terhadap Pancasila sesungguhnya cukup mengkhawatirkan dalam konteks kehidupan berbangsa dan bernegara. Oleh karenanya, implementasinya secara jujur—termasuk dalam pembaharuan hukum pidana nasional—menjadi keniscayaan.
