PEMBARUAN KEBIJAKAN PEMIDANAAN DALAM RANGKA MENGATASI FAKTOR PENYEBAB OVERCROWDING LEMBAGA PEMASYARAKATAN DI INDONESIA

Abstract
This paper examines population density as the main problem faced by the majority of correctional institutions in Indonesia. Overcrowding is a downstream problem that cannot be solved partially, so a comprehensive understanding of politics and legal policies in Indonesia is needed. This paper is a doctrinal research, with a literature study and a comparison of several countries in correctional management institutions to be used to determine the causes of overcrowding. The results of the study show that the legal and judicial systems in Indonesia still contribute to overcrowding with the implementation of long detention periods before the trial process, the number of laws and regulations that prioritize punitive functions with the application of criminal sanctions in prison compared to rehabilitative functions.
