MEMPERTIMBANGKAN ASPEK-ASPEK NON LEGAL FORMAL DALAM PENYELESAIAN SENGKETA TANAH ADAT DI BALI

Abstract

The resolution of customary land disputes in Bali, based on formal justice in state court sessions, often ignores non-legal formal aspects that create injustice. This article puts forward a sociolegal approach to discuss the legal importance of considering formal and non-legal aspects in resolving customary land disputes in Bali. It describes the evaluative non-legal formal elements in question. The rationale for theoretically and juridically considering formal and non-legal aspects in resolving customary land disputes in Bali has found its place. Considering that in the current efforts to develop national law, it is important to prioritize a legal pluralism approach to realize substantive justice. Forms of non-legal formal aspects that should be considered are religious and socio-cultural aspects intertwined in customary land control in Bali.
