REKONSTRUKSI HUKUM PERLINDUNGAN DAN PENEGAKAN HAM BAGI IBU RUMAH TANGGA TERHADAP RISIKO TERTULAR HIV/AIDS DARI SUAMINYA

Abstract

The number of HIV cases in Indonesia shows that there is an increase in incidents that happen among women, particularly housewives. It, then, is followed by an increase in the percentage of HIV cases on children because they are contracted from their biological mothers. The implication of this will cause a lot of suffers for mothers and children who live with HIV/AIDS, and their families due to the emergence of stigma and discrimination. The reconstruction of concept of legal protection towards this risk is urgently needed because the positive law tends to protect the individual rights of husbands as sufferers without taking into account the rights of wives and children.

Kasus HIV di Indonesia menunjukkan peningkatan insiden terhadap ibu rumah tangga yang diikuti dengan meningkatnya persentase kasus HIV pada anak karena tertular dari ibu kandungnya. Hal ini terjadi pada mereka yang memiliki suami yang memiliki kebiasaan berisiko seperti penggunaan narkoba suntik terkontaminasi dan hubungan seks ekstra marital. Kondisi seperti ini mengakibatkan berbagai penderitaan bagi ibu dan anak yang hidup dengan HIV/AIDS , maupun keluarganya karena munculnya stigma dan diskriminasi. Rekonstruksi konsep perlindungan hukum terhadap adanya risiko ini bersifat mendesak karena hukum positif cenderung melindungi hak individu suami sebagai penderita tanpa mengindahkan hak asasi isteri maupun anak.
