Hal ini terjadi pada mereka yang memiliki suami yang memiliki kebiasaan berisiko seperti penggunaan narkoba suntik terkontaminasi dan hubungan seks ekstra marital. Kondisi seperti ini mengakibatkan berbagai penderitaan bagi ibu dan anak yang hidup dengan HIV/AIDS , maupun keluarganya karena munculnya stigma dan diskriminasi. Rekonstruksi konsep perlindungan hukum terhadap adanya risiko ini bersifat mendesak karena hukum positif cenderung melindungi hak individu suami sebagai penderita tanpa mengindahkan hak asasi isteri maupun anak.
