EKSISTENSI HAK MORAL DALAM HAK CIPTA DI INDONESIA

Pengaturan hak cipta di Indonesia telah beberapa kali mengalami perubahan; dan yang berlaku hingga saat ini adalah Undang – Undang Nomor 19 Tahun 2002 yang memuat konsep dasar hak cipta sebagai hak eksklusif dan hak yang timbul secara otomatis. Sifat eksklusif hak cipta memiliki dua esensi penting, yaitu hak moral dan hak ekonomi. Perlindungan hukum diberikan terhadap suatu karya cipta yang dihasilkan oleh pribadi seorang pencipta atas pengorbanan yang telah dilakukannya. Hal ini menjadikan pemenuhan atas hak moral seorang pencipta menjadi penting sebagai bentuk penghargaan atas integritas dan identitasnya. Namun, UU No.19 tahun 2002 belum memuat secara rinci mengenai hak moral dan cenderung hanya mengadopsi Auteurswet yang mengesankan economic heavy. Padahal pemenuhan hak moral seorang pencipta seharusnya berjalan seiring dengan pemenuhan hak ekonomi yang dimilikinya.

Abstract

Regulation about copyright in Indonesia has experienced several changes; and applicable to the present is Nation Copyright Act Number 19 Year 2002. Based on that Act, we should know about basis of the concept of copyright that is about exclusive rights and automatically rights. That exclusive character contain two important essences that are moral rights and economic rights.

Legal protection granted to a creation produced by an author / creator on a personal sacrifice he had made. This makes the fulfillment of the moral rights of a creator to be important as a form of respect for the integrity and identity. However, Nation Copyright Act No. 19 Year 2002 contains detailed have the moral right and tend to adopt Auteurswet causing heavy economic impression. In fact, the fulfillment of a moral right should be balance with its economic rights fulfillment.
