Abstrak Komisi Pemberantasan Korupsi (KPK) merupakan lembaga yang didesain khusus karena kegagalan lembaga konvensional (kejaksaan dan kepolisian) dalam memberantas korupsi. Karena pertimbangan itu, kehadiran KPK tidak dimaksudkan sebagai lembaga yang bersifat sementara. Dalam posisi seperti itu, tulisan ini menjelaskan dasar argumentasi dan legitimasi pembentukan penyidik KPK. Secara hukum, banyak undang-undang membuka kesempatan atau kemungkinan penyidik selain kepolisian. Artinya, sebagai lembaga yang memiliki wewenang untuk melakukan penyidikan, KPK berwenang untuk merekrut penyidik sendiri. Abstract

Komisi Pemberantasan Korupsi (KPK) merupakan lembaga yang didesain khusus karena kegagalan lembaga konvensional (kejaksaan dan kepolisian) dalam memberantas korupsi. Karena pertimbangan itu, kehadiran KPK tidak dimaksudkan sebagai lembaga yang bersifat sementara. Dalam posisi seperti itu, tulisan ini menjelaskan dasar argumentasi dan legitimasi pembentukan penyidik KPK. Secara hukum, banyak undang-undang membuka kesempatan atau kemungkinan penyidik selain kepolisian. Artinya, sebagai lembaga yang memiliki wewenang untuk melakukan penyidikan, KPK berwenang untuk merekrut penyidik sendiri.
