LITIGASI PERUBAHAN IKLIM DI INDONESIA: IDENTIFIKASI ISU DAN PERBUATAN MELAWAN HUKUM

Abstract

Litigasi perubahan iklim di Indonesia mengalami perkembangan cukup pesat, mengingat bertambahnya jumlah perkara dan putusan terkait gugatan litigasi perubahan iklim. Melihat praktik litigasi perubahan iklim, setelah dilakukan pemilahan serta identifikasi isu/motivasi, maka litigasi perubahan iklim di Indonesia, meliputi jenis litigasi dengan motivasi perubahan iklim bukan sebagai isu utama dan litigasi bukan motivasi perubahan iklim, namun berimplikasi pada mitigasi dan adaptasi perubahan iklim. Tujuan tulisan ini yaitu untuk menganalisis tindakan perbuatan melawan hukum yang dilakukan oleh pelaku pelanggaran hukum dengan mendasarkan kepada doktrin kesengajaan, kelalaian, pertanggungjawaban mutlak, dan tindakan faktual. Riset ini dapat memberikan pilihan advokasi kebijakan perubahan iklim melalui litigasi di pengadilan bagi para pencari keadilan.
