ANALISIS PRAKTIK JUAL BELI TANAH YANG BERSTATUS LETTER C DI KECAMATAN KARANGGAYAM KABUPATEN KEBUMEN

Abstract

Abstract

Land sale and purchase process that signed as Letter C is a practice for custom land type obtained hereditary which then, its right convension to the state is not registered through the land office. Generally, that sale and purchase practice oftenly happen in Kranggayam District, Kebumen Regency. Therefore, the author interested to find out how the practice of sale and purchase letter C land cause people in Karanggayam are still perform this practice. The research is analytically descriptive with Law Sociology research method. So that, the author can get real description related to sale and purchase practice of Letter C land in Karanggayam. Practice of sale and purchase letter C land in Karanggayam, the implementation run in front of village headman of Karanggayam. Trading the land only based on the letter of outstanding tax returns from the seller and the process of the land rights by the seller to the buyer done at the time when also at the same time as payment process. Several factors cause it often happens in Karanggayam, are: Many parcels of land that have not been certified, convoluted land certification process, community culture in Karanggayam sale and purchase process with trading system under the hand.

Abstrak

Proses jual beli tanah yang berstatus letter C biasnya dilakukan terhadap tanah milik adat yang diperoleh secara turun-temurun kemudian konversi haknya ke Negara belum didaftarkan melalui Kantor Pertanahan. Praktik jual beli tersebut masih sering terjadi di Kecamatan Karanggayam Kabupaten Kebumen. Untuk itu penulis tertarik untuk mengetahui bagaimana proses jual beli tanah tersebut dan apa penyebab masyarakat Karanggayam masih melakukan praktik jual beli tanah berstatus letter C. Penelitian ini bersifat deskriptif analitis dengan menggunakan metode penelitian sosiologi hukum. Sehingga penulis dapat memperoleh gambaran terkait dengan praktik jual beli tanah yang berstatus letter C di Kecamatan Karanggayam. Praktik jual beli tanah berstatus Letter C di Kecamatan Karanggayam pada umumnya dilakukan dihadapan Kepala Desa dan saksi aparat Desa Karanggayam. Jual beli tanah tersebut hanya didasarkan atas Surat Pemberitahuan Pajak Terhutang dari penjual dan proses penyerahan hak atas tanah oleh penjual kepada pembeli dilakukan pada saat itu juga bersamaan dengan proses pembayaran harga dari pembeli kepada penjual. Beberapa faktor penyebab seringnya terjadi jual beli tanah tersebut yaitu: banyaknya bidang tanah yang belum bersertifikat, proses sertifikasi tanah yang berbelit-belit, serta kultur budaya masyarakat Kecamatan Karanggayam yang sudah terbiasa melakukan proses jual beli dibawah tangan.
