AKIBAT HUKUM HUTANG PIUTANG MENGGUNAKAN PERJANJIAN DI BAWAH TANGAN DALAM HAL TERJADI WANPRESTASI

Abstract

Debt indebtedness activities are not uncommon to cause problems, usually between creditor and debtor solve it by way of deliberation and if it can not be resolved through deliberation then the settlement through the judicial body is a last resort that can be taken. The problems in this research are about the legal effect on the parties in the debt payable agreement using the deed under the hand, and the strength of the debt indebtedness corrateral of land rights under the hand if there is default  to know and analyze the legal effect against the parties in the agreement payable debt agreement under the hand as well as the contractual power of the debt with the corrateral of the right to land if there is default.

Abstrak

Kegiatan hutang piutang ini tidak jarang menimbulkan permasalahan, biasanya antara kreditor dan debitor menyelesaikannya dengan jalan musyawarah dan apabila tidak dapat diselesaikan melalui musyawarah maka penyelesaian melalui badan peradilan merupakan suatu upaya terakhir yang dapat ditempuh. Permasalahan dalam penelitian ini yaitu mengenai akibat hukum terhadap para pihak dalam perjanjian hutang piutang menggunakan akta dibawah tangan, dan kekuatan hukum perjanjian hutang piutang dibawah tangan jika terjadi wanprestasi.
