Abstract

The supervision and utilization of village assets provided for the Laws and Regulations authorizes the Village Government to increase village income through Bangun Guna Serah (Build, Operate And Transfer / BOT) collaboration with investors, this is the basis for the agreement between the Banjardawa Village Government as the owner. Village Treasury Land with CV. Engineering Cadets through Investor Agreement (Development) Number: 050/184/2011. This research uses qualitative research with empirical juridical methods. The results revealed that first, the implementation of the management and utilization of village assets through a build, operate and transfer (BOT) agreement was carried out to increase the income of Banjardawa Village, which has village treasury lands that were not fully utilized. Second, the build-to-use agreement ( Build, Operate and Transfer / BOT) has advantages and disadvantages that will be obtained for both the Banjardawa Village Government and CV. Taruna Teknik as investor. Making agreements using sufficient knowledge and understanding can lower the raised risks from the utilization of village assets through the Bangun Guna Serah collaboration.

Abstrak

Pengelolaan dan pemanfaatan aset desa yang disediakan dalam Peraturan Perundang-undangan memberikan kewenangan pada Pemerintah Desa untuk meningkatkan pendapatan desa menggunakan kerjasama Bangun Guna Serah (Build, Operate And Transfer/BOT) bersama pihak investor hal ini menjadi dasar adanya perjanjian antara Pemerintah Desa Banjardawa sebagai pemilik Tanah Kas Desa dengan CV. Taruna Teknik melalui Surat Perjanjian Investor (Pengembangan) Nomor : 050/184/2011.Riset ini menerapkan model riset kualitatif serta metode yuridis empiris.Hasil penelitian menunjukan bahwa Pertama, Pelaksanaan Pengelolaan dan Pemanfaatan Aset Desa Melalui Perjanjian Bangun Guna Serah (Build, Operate and Transfer/BOT) dilakukan untuk memberi peningkatan perolehan Desa Banjardawa yang memiliki tanah kas desa yang tidak dimanfaatkan secara maksimal, Kedua, Perjanjian Bangun Guna Serah (Build, Operate and Transfer/BOT) mempunyai keuntungan dan kerugian yang akan didapatkan baik untuk pihak Pemerintah Desa Banjardawa maupun CV. Taruna Teknik selaku investor. Pembuatan perjanjian dengan menggunakan pengetahuan dan pemahaman yang cukup dapat mengurangi resiko yang ditimbulkan dari pemanfaatan aset desa melalui kerjasama Bangun Guna Serah.
