Abstract

Air transportation in other terms is called air transportation. There are several air transport companies in Indonesia, one of which is "Wings Air". Wings air has responsibility for ensuring the safety and security of its passengers from the beginning of departure to the end of the destination according to the agreement stated in the airplane ticket starting from the time of an accident, flight delay, flight delay, as well as damage and loss of items placed in checked baggage. This article discusses the implementation of rights and obligations as well as regulations in the transportation agreement between the carrier and the passenger and the legal responsibility given by Wings Air for the carriage of passengers and baggage. The research method used in this article is juridical normative. The results of the research show that the implementation of the agreement between the airline and the passenger is theoretically in accordance with the provisions of the applicable laws and regulations, but in practice/implementation of the agreement, it has not been realized as a whole. Services to passengers are considered unsatisfactory and in accordance with the level of interest and satisfaction of consumers to the maximum.

Abstrak

Transportasiudaradengan istilah laindisebutpengangkutanudara. Ada beberapa perusahaan penganggutan udara di Indonesia, salah satunya “WingsAir”. Wings air  memiliki tanggung jawab atas terjaminya keamanan dan keselamatan para penumpangnya dari awal berangkat sampai akhir tujuan sesuai perjanjian yang tercantum dalam tiket pesawat mulai dari ketika terjadi kecelakaan,penundaanpenerbangan,keterlambatanpenerbangan,sertarusakdanhilangnyabarangyangditempatkanpadabagasitercatat.ArtikelinimembahasmengenaipelaksanaanhakdankewajibansertaperaturandalamperjanjianpengangkutanantaraperusahaanpengangkutandenganpenumpangdantanggungjawabhukumnyayangdiberikanolehMaskapaiPenerbanganWingsAirterhadappengangkutanpenumpangdanbagasi.Metodepenelitianyangdigunakandalamartikeliniyuridisnormatif.Hasilpenelitian diketahui bahwa pelaksanaan perjanjian antara perusahaan penerbangan dengan penumpang secara teoritis telah sesuai dengan ketentuan peraturan perudang-undangan yang berlaku, namun secara praktek/pelaksanaan perjanjian, belum merealisasikan secara nyata secara keseluruhan. Pelayanan kepada penumpang dinilai belum memuaskan dan sesuai dengan tingkat kepentingan dan kepuasan konsumensecaramaksimal.
