MAKNA FILOSOFIS PUTUSAN MAHKAMAH KONSTITUSI DALAM CONSTITUTIONAL REVIEW DAN URGENSI JUDICIAL ACTIVISM

Abstract
The establishment of Constitutional Courts (MK) globally often marks the transition from authoritarian to democratic governance, with constitutional review as their primary authority. Studies of MK formation across Europe, America, Africa, and Asia highlight their role in upholding democracy. Judicial activism has emerged as a progressive approach within constitutional review, strengthening the constitution and the principle of checks and balances. However, in practice, some MK decisions are not followed by their addressees, despite their philosophical significance in Indonesia's constitutional framework. This normative research employs case studies and comparative legal studies to emphasize the philosophical strength of MK decisions, particularly in constitutional review authority. Judicial activism is deemed essential for enforcing the constitution and preserving the philosophical values of Pancasila enshrined in the 1945 Constitution.
