PERLINDUNGAN HAK CIPTA ATAS MOTIF BATIK BUKETAN SEBAGAI WARISAN BUDAYA DI PEKALONGAN (Studi Terhadap Karya Seni Batik Tradisional Pekalongan)

Abstract

The legal basis for the protection of traditional works of art is contained in Copyright Act of 2014 that the work of unknown copy of the inspector then the work is protected by the State. In fact, this article has not been optimal in protecting artwork especially Batik Buketan Pekalongan because it is still only limited to acknowledged but legally not yet have strong protection. The method used in this research is with empirical juridical approach.Research findings show that in the implementation on the field, UUHC Year 2014 can not accommodate the Copyright protection of traditional batik motif as part of folklore, this is because the Copyright Law still has some weaknesses if it is to be applied consequently in order to protect folklore. Therefore, special arrangement of folklore is required, with the establishment of a separate regulatory framework concerning traditional knowledge / folklore (sui generis).

Abstrak

Dasar hukum perlindungan karya seni tradisional tertuang pada UU Hak Cipta Tahun 2014 bahwa karya cipta yang tidak diketahui peniliknya maka karya tersebut dilindungi oleh Negara. Faktanya pasal ini belum optimal melindungi karya seni khususnya Batik Buketan Pekalongan karena masih karya tersebut hanya sebatas diakui namun secara legalitas belum memiliki perlindungan yang kuat. Metode yang digunakan dalam penelitian ini adalah dengan pendekatan yuridis empiris. Hasil temuan menunjukkan bahwa dalam implementasi di lapangan, UUHC Tahun 2014 belum bisa mengakomodir perlindungan Hak Cipta atas motif batik tradisional sebagai bagian dari folklore, hal ini dikarenakan UU Hak Cipta masih mempunyai beberapa kelemahan bila hendak diterapkan untuk melindungi folklore, yakni perlunya pengaturan secara khusus terhadap folklore, yaitu dengan dibentuknya suatu kerangka pengaturan tersendiri mengenai pengetahuan tradisional/folklore (sui generis).
