Abstract

Abstract

The use of social media for publication and the promotion of a notary public, is in serious violation of the code of ethics and must abide by the current laws of the law. To address these infractions is to apply oversight of the notary. Based on this matter it has a problem set up with how the law will result when the notary promotes itself in the social media account of instagram, and the approach method used in this article is pedekatan yuridis normatif. According to the results of the notary paper, notary notaries violated the promotion and self-publication of social media on instagram, the notary was not allowed because of this restriction asa result of notary professorship asa public official in accordance with the ethical code of the notary. As the enforcement of the ethics of the notary, the honorary council of the notary and the control of the notary has a duty of ensuring that the notary understands and executes its code. The notarization of sanctions to the notary to the main chamber of the circuit overseer's chamber was the authority of the circuit overseer's chamber: a dishonorably discharge, and a temporary discharge of 3 (three) months through 6 (six) months. The decisions of the circuit overseer's chamber are final.

Abstrak

Penggunaan media sosial untuk publikasi dan mempromosikan jasa notaris, dinilai sangat melanggar kode etik dan harus mematuhi aturan hukum yang berlaku. Untuk mengatasi adanya pelanggaran ini adalah diterapkan adanya pengawasan terhadap notaris. Artikel ini mengangkat rumusan masalah mengenai akibat hukum apabila notaris mempromosikan dirinya di akun media sosial Instagram.Metode pendekatan yang digunakan dalam artikel ini yaitu pendekatan yuridis normatif. Berdasarkan hasil penelitian penulis bahwa notaris melakukan pelanggaran apabila melakukan promosi dan publikasi diri di sosial media yaitu instagram, notaris ini tidak diperbolehkan karena larangan ini adalah akibat dari kedudukan profesi notaris sebagai pejabat umum sesuai dengan kode etik notaris. Sebagai penegak Kode etik notaris, Dewan Kehormatan Notaris dan Majelis Pengawasan Notaris memiliki tugas yaitu telah dipastikan supaya notaris paham pada pelaksanaan kode etik dengan sebaik-baiknya. Pengusulan dalam penetapan sanksi kepada pihak notaris ke majelis pengawas pusat merupakan kewenangan yang dimiliki dari majelis pengawas wilayah berupa yaitu diberhentikan dengan cara yang tidak hormat, dan diberhentikan dalam kurun waktu 3 bulan hingga 6 bulan. Keputusan yang dikeluarkan dari majelis pengawas wilayah ini bersifat sebagai suatu keputusan yang dianggap final.
