Abstract

The sale and acquisition of uncertified land is usually carried out in front of the Village Head, but to ensure the security to community, this is carried out in front of a PPAT.  Problems in study (1) how the legality of the sale and purchase of uncertified land carried out before PPAT based on Decision Number 75/PDT/2016/PT.DP, (2) how the judge's consideration in deciding default by I Gede Darma Yudha, S.H., M.Kn.  Notary/PPAT in Decision Number 75/PDT/2016/PT.DPS. The research is normative research. The research contains primary and optional legitimate materials. The information assortment method is record study. The exploration was analyzed by descriptive and argumentative techniques. The results showed that the sale and purchase uncertified land was carried out with an underhand agreement that did not meet  legal requirements of the agreemen so agreement under the hand is declared null and void. The actions of I Gede Darma Yudha, S.H., M.Kn. Notary/PPAT has received payment and management of uncertified land sale and purchase basically, he has committed himself as a seller in an underhand sale and purchase agreement.

Abstrak

Jual beli tanah belum bersertifikat biasanya dilakukan dihadapan Kepala Desa, namun untuk menjamin keamanan masyarakat melakukan jual beli tanah belum bersertifikat dihadapan PPAT. Permasalahan penelitian : (1) bagaimana keabsahan jual beli tanah  belum bersertifikat yang dilaksanakan dihadapan PPAT berdasarkan pada Putusan Nomor 75/PDT/2016/PT.DPS, (2) bagaimana pertimbangan hakim dalam memutuskan wanprestasi yang dilakukan oleh I Gede Darma Yudha, S.H., M.Kn. sebagai Notaris/PPAT pada putusan Nomor 75/PDT/2016/PT.DPS. Penelitian ini adalah penelitian normatif. Penelitian ini terdapat bahan hukum primer dan bahan hukum sekunder. Metode pengumpulan informasi melalui studi dokumen. Penelitian dianalisis dengan teknik deskriptif dan argumentatif. Hasil penelitian menyatakan jual beli tanah belum bersertifikat  dilaksanakan dengan perjanjian dibawah tangan yang tidak memenuhi syarat sah perjanjian sehingga perjanjian dibawah tangan  dinyatakan batal demi hukum. Perbuatan I Gede Darma Yudha, S.H., M.Kn. sebagai Notaris/PPAT telah menerima uang pembayaran dan pengurusan jual beli tanah belum bersertifikat pada dasarnya telah ikut mengikatkan diri sebagai penjual dalam perjanjian jual beli di bawah tangan.
