Abstract

The establishment of a Limited Liability Company must be proven by a Notary Deed and used as an attachment to the registration of the PT. Mubarokfood Cipta Delicia trademark as legal evidence in legal evidence. This thesis uses a normative juridical approach. The data source is in the form of secondary legal materials and data analysis is qualitative. The results of the study indicate that the legal consequences that arise for the home industry that falsify the PT. MubarokFood Cipta Delicia by the judge the defendant was found guilty and sentenced. The judge's consideration regarding the facts and constitutes a violation of the law by the defendant, namely the registration of the PT. MubarokFood Cipta Delicia at the Directorate General of Intellectual Property Rights (formerly the Directorate General of Copyright, Patents, Trademarks)-Ministry of Law and Human Rights, so that there is recognition of rights from the state on the brand. The role of the Notary in the trademark rights owner of PT. MubarokFood Cipta Delicia is the deed of establishment by a Notary.

Abstrak

Perseroan Terbatas pendiriannya harus dibuktikan dengan Akta Notaris dan digunakan sebagai lampiran pendaftaran merek dagang PT. Mubarokfood Cipta Delicia sebagai alat bukti sah dalam pembuktian secara hukum. Penelitian ini menggunakan metode pendekatan yuridis normatif. Sumber data berupa bahan hukum sekunder dan analisis data bersifat analisis kualitatif. Hasil penelitian menunjukkan bahwa akibat hukum yang timbul bagi home industry yang memalsukan Merek PT. MubarokFood Cipta Delicia oleh Hakim, terdakwa dinyatakan bersalah dan dijatuhi hukuman. Pertimbangan hakim tentang fakta dan merupakan pelanggaran hukum yang dilakukan terdakwa yaitu telah didaftarkannya merek PT. MubarokFood Cipta Delicia pada Direktorat Jenderal Hak Kekayaan Intelektual (dahulu Direktorat Jenderal Hak Cipta, Paten, Merek)-Kementerian Hukum dan HAM, sehingga ada pengakuan hak dari negara atas mereknya. Peran Notaris dalam perlindungan hukum terhadap pemegang Hak Atas Merek Dagang PT. MubarokFood Cipta Delicia adalah dengan telah dibuatnya akta pendiriannya oleh Notaris.
