ABSTRACT

One of the issues that arose from the BLBI in Indonesia is the contribution of moral hazard by bank owners to bank failures, and the regulations regarding the provision of liquidity assistance. This study aims to analyse blanket guarantees, liquidity loans, " Assistance ", moral hazard, and related regulations. This legal research adopts a doctrinal method with a statutory and conceptual approach. These findings indicate that BLBI, liquidity loans, and blanket guarantees can increase moral hazard as bankers or practitioners believe that the government will never allow banks to fail. This study focuses on the risk of 'comprehensive guarantees', the importance of mitigating moral hazard, and the limitation of guarantees in maintaining publik trust and preserving the stability of the banking.

ABSTRAK

Salah satu masalah yang muncul dari BLBI di Indonesia adalah kontribusi moral hazard pemilik bank terhadap kegagalan bank, serta regulasi mengenai pemberian bantuan likuiditas tersebut. Studi ini bertujuan untuk menganalisis blanket guarantee, pinjaman likuiditi, frasa “bantuan”, moral hazard, dan regulasi. Penelitian hukum ini mengadopsi metode doktrinal dengan pendekatan undang-undang dan konseptual. Temuan ini menunjukkan bahwa BLBI, pinjaman likuiditi dan jaminan menyeluruh dapat meningkatkan moral hazard apabila tidak disertai informasi yang kredibel tentang kualitas bank dan kualitas jaminan karena para bankir atau praktisi percaya bahwa pemerintah tidak akan pernah membiarkan bank gagal. Studi ini fokus pada risiko 'jaminan menyeluruh', pentingnya mitigasi bahaya moral, dan pembatasan jaminan dalam menjaga kepercayaan publik dan mempertahankan stabilitas sistem perbankan.
