RUANG UDARA DI ATAS ALUR LAUT KEPULAUAN INDONESIA (ALKI): SEBUAH TINJAUAN HUKUM

Abstract
Penulisan ini bertujuan untuk mengetahui status dan karakteristik dari perspektif hukum terhadap ruang udara diatas Alur Laut Kepulauan Indonesia (ALKI) dalam relasinya dengan kedaulatan yang bisa dilaksanakan oleh negara kepulauan. Berdasarkan kajian normatif didapatkan hasil bahwa pada ruang udara di atas ALKI dibawah rezim hukum khusus (sui generis) sebagai inovasi yang lahir pasca UNCLOS 1982, menjadikan pelaksanaan kedaulatan negara di wilayah udara dibatasi. Selanjutnya, pelaksanaan kedaulatan oleh negara tidak dapat menerapkan hard law yang dapat berpotensi menghambat dan menangguhkan pelaksanaan hak lintas penerbangan alur laut kepulauan oleh pesawat udara asing, hal ini juga telah terlihat secara historis dalam perumusan konsep awal negara kepulauan dalam UNCLOS 1982.
