Banking financial institutions have an important role in improving the economy of the people in Indonesia. Providing credit facilities to customers to increase community economic growth. However, not a few losses experienced by banks due to credit that failed to pay or credit that cannot be paid off by credit customers. Based on this, this study will analyze efforts to minimize losses caused by credit, namely preventive efforts before the implementation of the credit agreement with the customer. This study uses normative legal research methods, namely research that puts forward secondary data in the form of legislation related to banking, books, and legal research journals. This study shows the need for the application of the bank's precautionary principle before providing credit facilities to customers to minimize the risk of default on loans by customers. These principles are known as the five C’s of Credit (Character, Capacity, Capital, Condition, and Collateral) and the seven P’s of Credit (Personality, Party, Purpose, Prospect, Payment, Profitability, and Protection).

Abstrak

 

Lembaga keuangan perbankan memiliki peranan penting dalam meningkatkan perekonomian masyarakat di Indonesia. Pemberian fasilitas kredit kepada nasabah merupakan salah satu upaya untuk meningkatkan pertumbuhan ekonomi masyarakat. Namun, tidak sedikit kerugian yang dialami perbankan akibat keredit yang gagal bayar atau kredit yang tidak mampu dilunasi oleh nasabah kredit. Atas dasar hal tersebut, maka penelitian ini akan menganalisis upaya untuk meminimalisir kerugian yang diakibatkan oleh adanya kredit, yaitu upaya preventif sebelum dilaksanakannya perjanjian kredit dengan nasabah. Penelitian ini menggunakan metode penelitian hukum normatif, yaitu penelitian yang mengedepankan data sekunder berupa peraturan perundang-undangan terkait perbankan, buku, dan jurnal penelitian hukum. Penelitian ini menunjukan perlu adanya penerapan prinsip kehati-hatian bank sebelum memberikan fasilitas kredit kepada nasabah agar meminimalisir risiko gagal bayar atas kredit oleh nasabah. Prinsip tersebut dikenal dengan the five C’s of Credit (Character, Capacity, Capital, Condition, dan Collateral) dan the seven P’s of Credit (Personality, Party, Purpose, Prospect, Payment, Profitability, dan Protection).
