These principles are known as the five C’s of Credit (Character, Capacity, Capital, Condition, and Collateral) and the seven P’s of Credit (Personality, Party, Purpose, Prospect, Payment, Profitability, and Protection). Pemberian fasilitas kredit kepada nasabah merupakan salah satu upaya untuk meningkatkan pertumbuhan ekonomi masyarakat. Namun, tidak sedikit kerugian yang dialami perbankan akibat keredit yang gagal bayar atau kredit yang tidak mampu dilunasi oleh nasabah kredit. Atas dasar hal tersebut, maka penelitian ini akan menganalisis upaya untuk meminimalisir kerugian yang diakibatkan oleh adanya kredit, yaitu upaya preventif sebelum dilaksanakannya perjanjian kredit dengan nasabah. Penelitian ini menggunakan metode penelitian hukum normatif, yaitu penelitian yang mengedepankan data sekunder berupa peraturan perundang-undangan terkait perbankan, buku, dan jurnal penelitian hukum. Penelitian ini menunjukan perlu adanya penerapan prinsip kehati-hatian bank sebelum memberikan fasilitas kredit kepada nasabah agar meminimalisir risiko gagal bayar atas kredit oleh nasabah. Prinsip tersebut dikenal dengan the five C’s of Credit ( Character, Capacity, Capital, Condition, dan Collateral ) dan the seven P’s of Credit ( Personality, Party, Purpose, Prospect, Payment, Profitability, dan Protection ). Abstrak
Lembaga keuangan perbankan memiliki peranan penting dalam meningkatkan perekonomian masyarakat di Indonesia.
