PELAKSANAAN PUTUSAN YANG BERSIFAT CONDEMNATOIR DALAM PERKARA PEMBAGIAN HARTA BERSAMA (STUDI KASUS DI PENGADILAN AGAMA KUDUS)

Abstract

The purpose of this study was to determine the Condemnatoir Decision Implementation in the Case of Distributing Assets in the Holy Religious Court, the research method used in this study is an empirical Juridical research method that aims to examine the process of Conducting a decision on the distribution of joint assets by the Court, namely the Decision which is Condemnatoir regarding the distribution of shared assets is then connected theoretically based on applicable laws and regulations. The results of this study state that the implementation of a Condemnatoir Decision is a very important decision that must be made in order to protect and obtain legal certainty for the rights of the plaintiff and the defendant. The implementation of the distribution of shared assets in the Holy Court is in accordance with what is stipulated in the Act and there are still many factors that hamper the implementation of the distribution of shared assets from both the litigants and the court.

Abstrak
Tujuan penelitian ini adalah untuk mengetahui Pelaksanaan Putusan Yang Bersifat Condemnatoir Dalam Perkara Pembagian Harta Bersama di Pengadilan Agama Kudus, metode Penelitian yang digunakan dalam penelitian ini adalah metode penelitian Yuridis empiris yang bertujuan untuk memeriksa proses Pelaksanaan Putusan pembagian harta bersama oleh Pengadilan yaitu Putusan yang bersifat Condemnatoir perihal pembagian harta bersama kemudian dihubungkan secara teoritik berdasarkan undang-undang dan peraturan-peraturan yang berlaku. Hasil penelitian ini menyatakan bahwa pelaksanaan Putusan yang bersifat Condemnatoir adalah Putusan yang sangat penting yang harus dilakukan demi melindungi dan mendapatkan kepastian hukum terhadap hak-hak penggugat dan tergugat. Pelaksanaan Putusan pembagian harta bersama di Pengadilan Kudus sudah sesuai dengan apa yang diatur di dalam Undang-Undang dan masih terdapat banyak faktor penghambat pelaksanan Putusan pembagian harta bersama baik dari pihak yang berperkara maupun dari pihak Pengadilan.
