Perolehan Sertipikat Hak Milik Atas Satuan Rumah Susun (Studi Di Star Apartemen)

Obtaining the certificate property rights over units of Flats as a sign of ownership of units of flats. The existence of legal protection of property rights of the owner of the certificate upon the units of Flats are needed because most investors are just concerned with this aspect of the bona fide profits or merely for their companies without paying attention to the problems that occur in the future that impact for investors or occupants of high-rise units. Requirements for FOREIGNERS who want to inhabit flats in Indonesia should be determined for the FOREIGN NATIONAL must not have owned property rights over land or buildings. Based on research results, obtaining the certificate property rights over units of flats can be done by purchasing units of flats, then make payment, issuance of the certificate and the next handover apartments. Legal protection of the certificate owner's property rights over units of Flats already existed when the publication of the certificate by the national land Agency. Then there are different terms for FOREIGNERS who want to inhabit flats/apartments in Indonesia one of them to a FOREIGN NATIONAL can only inhabit flats/apartments which was founded above the land usage rights over State land.

Abstrak

Perolehan Sertipikat Hak Milik atas Satuan Rumah Susun sebagai tanda sebuah kepemilikan atas satuan rumah susun. Adanya perlindungan hukum terhadap pemilik Sertipikat Hak Milik atas Satuan Rumah Susun diperlukan karena kebanyakan investor hanya mementingkan aspek keuntungan atau bonafit semata bagi perusahaan mereka saja tanpa memperhatikan masalah yang terjadi dikemudian hari yang berdampak bagi para investor maupun penghuni satuan rumah susun. Persyaratan WNA yang ingin menghuni rumah susun di Indonesia harus ditentukan karena WNA tidak boleh memiliki hak milik milik atas tanah maupun bangunan.Berdasarkan hasil penelitian, perolehan sertipikat hak milik atas satuan rumah susun dapat dilakukan dengan cara melakukan pembelian unit rumah susun, kemudian melakukan pembayaran, penerbitan sertipikat dan selanjutnya yaitu serah terima unit apartemen. Perlindungan hukum terhadap pemilik Sertipikat Hak Milik atas Satuan Rumah Susun sudah ada yaitu ketika diterbitkannya Sertipikat oleh Badan Pertanahan Nasional. Kemudian ada berbagai syarat bagi WNA yang ingin menghuni rumah susun/apartemen di Indonesia salah satunya yaitu bagi WNA hanya boleh menghuni rumah susun/apartemen yang didirikan diatas tanah hak pakai atas tanah negara.
