Abstract

Land registration is an effort to guarantee legal certainty and legal protection. In 2018, the Government through the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) issued Complete Systematic Land Registration program or commonly referred as PTSL where one of the objects of the PTSL program is absentee land. However, the implementation of the PTSL program, especially for absentee land, is not going well because in Indonesia there are still many absentee lands. This study aims to specify the implementation of the PTSL program on land with absentee status. This study used normative juridical approach. Related to data collection techniques, this research uses a literature study. The data analysis method is qualitative. The research results indicate that the PTSL Program, especially with absentee land registration has been implemented by the Government from 2018 to the present. The PTSL procedures for absentee land are generally the same as for other land objects. However, there are exceptions related to absentee land ownership which are allowed where this only applies to landowners who are carrying out state duties, landowners who fulfill religious obligations, civil servants, military officials and/or their equivalent, or other provisions that determined by the Minister.

Abstrak

Pendaftaran tanah merupakan upaya dalam menjamin kepastian hukum serta perlindungan hukum. Pada tahun 2018, Pemerintah melalui Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional (ATR/BPN) mengeluarkan program yang bernama Pendaftaran Tanah Sistematis Lengkap atau biasa disebut PTSL yang mana salah satu objek program PTSL adalah tanah absentee. Akan tetapi, implementasi program PTSL, khususnya terhadap tanah absentee tersebut tidak berjalan dengan baik dikarenakan di Indonesia masih banyak terdapat tanah absentee hingga saat ini. Adapun penelitian berikut bertujuan guna mengetahui bagaimana implementasi program PTSL terhadap tanah berstatus absentee. Dipergunakan metode pendekatan penelitian yuridis normatif. Terkait dengan teknik pengumpulan data, penelitian berikut mempergunakan studi kepustakaan. Dipergunakan metode analisis kualitatif. Hasil penelitian memperlihatkan bahwasanya Program PTSL, khususnya dengan pendaftaran tanah absentee telah dilaksanakan oleh Pemerintah dari Tahun 2018 hingga saat ini. Adapun prosedur PTSL tanah absentee secara umumnya sama dengan objek tanah lainnya. Akan tetapi, terdapat pengecualian terkait dengan kepemilikan tanah absentee yang diperbolehkan dimana hal tersebut hanya berlaku bagi pemilik tanah yang menunaikan kewajiban agama, pemilik tanah yang sedang menjalani tugas negara, pejabat militer dan/atau yang dipersamakan dengan mereka, pegawai negeri, atau ketentuan lain yang ditetapkan Menteri.
