Penunjukan Camat Sebagai Ppat Sementara Di Wilayah Kerja Yang Formasi PPAT Telah Terpenuhi

Abstract

The Land Deed Official, every year continues to increase, and the role of the sub-district head as a temporary PPAT is needed because the PPAT formation is unfulfilled in the working area. While the number of PPATs in the East Java Region is quite a bit, however in several districts in East Java with a large number of PPAT there are also have Temporary PPAT. Based on this legal issue, this study aims to determine the role of the sub-district head as a temporary PPAT and what the consequences will be with the appointment of a sub-district head in areas where the PPAT formation has been fulfilled. The research method used in this writing is juridical and empirical, because in this study it will try to find and find the extent of the implementation of the applicable positive law. The results showed that the role of the sub-district head was still needed by Pertanahan Office, sub-district head was considered an official who was able to know the characteristics of his area. Meanwhile, the result of the appointment of the camat led to competition for services between the sub-district head as temporary PPAT and notary PPAT.

Abstrak

Pejabat Pembuat Akta Tanah setiap tahunnya terus meningkat, dan peran camat sebagai PPAT Sementara diperlukan karena kurang terpenuhinya formasi PPAT di wilayah kerja tersebut. Jumlah PPAT Sementara di Wilayah Jawa Timur tergolong sedikit namun dibeberapa kabupaten di Jawa Timur dengan jumlah PPAT yang banyak masih juga terdapat PPAT Sementara. Berdasarkan isu hukum tersebut penelitian ini bertujuan untuk mengetahui peranan camat sebagai PPAT Sementara dan bagaimana akibat yang ditimbulkan dengan tetap dilakukannya pengangkatan camat di wilayah yang formasi PPAT telah terpenuhi. Metode peneltian yang digunakan dalam penulisan ini adalah yuridis dan empiris, karena dalam penelitian ini akan berusaha mencari dan menemukan sejauh mana implementasi hukum postif yang berlaku. Hasil penelitian menunjukan bahwa peranan camat masih diperlukan oleh Kantor Pertanahan, camat dirasa sebagai pejabat yang mampu mengetahui karakteristik wilayahnya. Sementara itu akibat dari penunjukan camat menimbulkan persaingan jasa antara camat sebagai PPAT Sementara dan PPAT Notaris.
